Dissolution vs. Uncontested Divorce

According to the Ohio State Bar Association, divorce and dissolution are completely separate processes. If you do not want to show fault (aka “no-fault divorce”), you will have to pursue the dissolution option. To file for divorce in Ohio, you have to show fault, stating a grounds for divorce, and you must also have a witness to support that claim.

Fault grounds for divorce in Ohio:

  • Adultery
  • Willful absence for one or more years
  • Extreme cruelty
  • Habitual drunkenness
  • Gross neglect of duty
  • Fraudulent contract
  • Imprisonment

What dissolution and uncontested divorce have in common is that once finalized, the marriage is ended. And at Dailey Law Offices, we offer a flat fee, full-service package for either legal process.

How Long Does It Take to Get a Dissolution in Ohio?

Since all the debating and deciding has taken place prior to filing for a dissolution, a hearing will take place, no-fail, within 30-90 days of filing. This single court appearance involves each spouse stating their agreement with all the terms of the dissolution.

In order for a dissolution to be granted both parties must be in agreement on every aspect of the dissolution. Most of the final dissolution hearings of Dailey Law Offices’ family law clients are held at Dailey Law Offices and presided over by a private judge. In many instances, only one attorney is involved in a dissolution and may only represent one party. Dissolutions are quicker and much cheaper than divorces. If you are pursuing a dissolution, we would be happy to assist you.
